SC restores NAB amendments in unanimous decision

ISLAMABAD: (Suno News) The Supreme Court (SC) has approved the intra-court appeals of the federal government and restored the National Accountability Bureau (NAB) amendments, overturning the previous decision that had annulled the amendments.

Chief Justice of Pakistan (CJP) Qazi Faez Isa pronounced the reserved judgment in the NAB Amendments case. Justice Athar Minallah concurred with the majority opinion.

The decision was unanimous by 5-0, but Justice Athar Minallah dismissed the government’s appeals and approved the private appeals.

It should be noted here that the Supreme Court had reserved the judgement on June 6. The federal government had filed an intra-court appeal against the annulment of the NAB amendments passed during the regime of the Pakistan Democratic Movement (PDM).

The PDM government amended Sections 2, 4, 5, 6, 14, 15, 21, 23, 25 and 26 of the NAB rules. PTI founder Imran Khan filed a petition in the Supreme Court against the NAB amendments.

A three-member SC bench, headed by the then chief justice Umar Atta Bandial, reserved the verdict in the case on September 5, 2023.

On September 15, 2023, the Supreme Court declared the NAB amendments null and void while accepting the petition of the PTI founder. The Supreme Court had annulled nine out of 10 NAB amendments.

In response, the federal and provincial governments filed intra-court appeals in the Supreme Court against the annulment of the NAB amendments. The PTI founder filed a plea to present arguments in a personal capacity on the appeals filed in the NAB amendments case.

The Supreme Court formed a five-member larger bench for hearing the intra-court appeals on May 10, 2024. The larger bench allowed Imran Khan to appear through video link.
