LHC grants major relief to Rahat Fateh Ali Khan in property dispute case
The Lahore High Court announced the decision in the Rahat Fateh Ali Khan property dispute case and ruled that appeals should not be dismissed only on technical grounds. The court said justice must be provided on merit instead of minor procedural mistakes.
Justice Muhammad Sajid Mahmood Sethi issued an eight-page written verdict on the petition filed by Rahat Fateh Ali Khan. The Lahore High Court restored the singer’s appeal and directed him to deposit a fine of Rs100,000.
According to the court decision, Rahat Fateh Ali Khan had filed a civil suit in Faisalabad regarding possession of a double-storey house measuring 1 kanal and 9 marlas.
The dispute later became part of the Rahat Fateh Ali Khan property dispute case being heard in different courts.
The civil court had issued a decree against Rahat Fateh Ali Khan on May 14, 2019 After this decision, he challenged the verdict in the trial court.

However, the trial court dismissed the appeal after a court fee of Rs15,000 was not submitted within the given time. The Lahore High Court later observed that only four days had been given to deposit the fee, which was not enough.
The Lahore High Court stated that dismissing an appeal only due to non-payment of fee was against the principles of justice.
The court added that the right to appeal is an important legal right and should not be ended because of technical defects.

In the latest development of the Rahat Fateh Ali Khan property dispute case, the Lahore High Court directed all parties, including the singer, to appear before the relevant court on June 2.
The trial court was also instructed to decide the matter on merit within two months without unnecessary delay.
