LAHORE (Web Desk): The Lahore High Court has issued an important decision on Khula in Pakistan, ruling that a woman’s right to Haq Mehr remain intact even without rukhsati or couple living together.

The judgment is being viewed as a significant step in explaining haq mehr law Pakistan and clearing up confusion over khula and haq mehr.

Woman remains entitled to haq mehr

According to the Lahore High Court decision, a woman does not lose her right to haq mehr simply because the marriage was not consummated.

The court ruled that if the nikahnama does not specify when the haq mehr is to be paid, the husband is legally bound to pay the full amount immediately.

The court also stated that if the nikahnama does not clearly mention the payment terms or conditions of the haq mehr, the entire amount will be considered payable on demand.

Legal experts say this interpretation strengthens haq mehr law Pakistan and removes uncertainty in many family disputes.

Court rules on gold, land and house listed as haq mehr

In the case before the court, the nikahnama included 10 tolas of gold, 1 kanal of land, and a house as haq mehr.

The Lahore High Court ruled that all these assets fall under immediate payment and must be provided by the husband without delay.

The Lahore High Court also clarified the legal position on khula in Pakistan. The court ruled that if a woman seeks to end her marriage through khula, she must return 25 percent of the haq mehr to her husband.

According to the Lahore High Court decision, the marriage will be considered dissolved through khula once this legal requirement has been fulfilled.
