ISLAMABAD: (Suno News) The Supreme Court (SC) bench, hearing intra-court appeals against the verdict that had declared the military trials of civilians null and void, collapsed on Monday after Justice Tariq Masood disassociated himself from the bench.

A six-member bench, headed by Justice Sardar Tariq Masood, had been formed to hear the intra-court appeals against the trial of civilians in military courts.

Justice Aminuddin Khan, Muhammad Ali Mazhar, Justice Hasan Azhar Rizvi, Justice Musarrat Hilali, and Justice Irfan Saadat were part of the bench.

At the beginning of Monday’s hearing, Jawad S. Khawaja’s lawyer, Khawaja Ahmed Hasan, objected to the bench and stated that the matter should be sent to the judges’ committee for the reconstitution of the bench.

On the occasion, Lahore Bar’s lawyer Hamid Khan tried to give his arguments in the case at which Justice Sardar Tariq Masood said, “Don’t give arguments when we don’t want to hear the case. An objection is being raised against us that I should withdraw from the case.”

He then recused himself from the bench due to which it dissolved and the matter was sent to the judges committee for the reconstitution of the bench.

Now a three-member judges committee will constitute a new larger bench for hearing the intra-court appeals.

It should be remembered here that in December 2023, the Supreme Court suspended the judgement to stop the trial of civilians in military courts. On October 23 last year, the apex court declared the military trial of civilians in military courts null and void.
