According to details the petition was filed under Article 184(3) of the Constitution. It asserts that Parliament cannot curtail or transfer the Supreme Court’s constitutional jurisdiction to any other body or forum. It terms the proposed amendment unconstitutional and void, warning that such measures would weaken the highest court’s authority.
Justice (retd) Khawaja has urged the Supreme Court to strike down any amendment that diminishes its jurisdiction and reaffirm that only the Supreme Court has the constitutional authority to determine the validity of such changes.

The petition also challenges provisions regarding the transfer of High Court judges and calls for a stay on the implementation of the disputed amendment until a final decision is reached.
According to the plea, granting the Supreme Court’s powers to a proposed Constitutional Court or any parallel institution would directly violate the Constitution and undermine the judiciary’s independence, setting a dangerous precedent for the separation of powers in Pakistan.
